Chapter 47 of the Texas Penal Code defines gambling related offenses.
“Gambling Promotion”, as per § 47.03 of the Texas Penal Code, occurs when a person knowingly or intentionally:
*operates or participates in the earnings of a gambling place;
*engages in bookmaking;
*for gain, becomes a custodian of anything of value bet or offered to be bet;
*sells chances on the partial or final result of or on the margin of victory in any game or contest or on the performance of any participant in any game or contest or on the result of any political nomination, appointment, or election or on the degree of success of any nominee, appointee, or candidate; or
*for gain, sets up or promotes any lottery or sells or offers to sell or knowingly possesses for transfer, or transfers any card, stub, ticket, check, or other device designed to serve as evidence of participation in any lottery.
OFFENSES AGAINST PUBLIC HEALTH, SAFETY, AND MORALS. In this chapter: (1) ’Bet’ means an agreement to win or lose something of value solely or partially by chance. Gambling by agreeing with each other that they would engage in conduct that constituted said offense, and the defendant Rogelio Castillo Mata, Anastacio Rocha and John Frank Cuellar performed an overt act in pursuance of said agreement, to—wit: Gambling promotion. In Violation of the Texas Penal Code Section 71.02, Engaging in. O robbery, as defined by §29.02, Texas Penal Code, o aggravated robbery, as defined by §29.03, Texas Penal Code, o unlawfully carrying a weapon, as defined by §46.02, Texas Penal Code, o murder, as defined by §19.02, Texas Penal Code, o capital murder, as defined by §19.03, Texas Penal Code.
